By accessing or using OweMeList ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.
2. Description of Service
OweMeList is a personal debt tracking application designed to help individuals keep records of money lent to others. The Service provides tools for:
- Recording and tracking personal debts
- Managing payment schedules and due dates
- Sending payment reminders
- Maintaining contact information for debtors
- Viewing payment history and analytics
IMPORTANT: OweMeList is intended for personal use only and is not a financial services platform, accounting software, or legal collection service.
3. Limitation of Liability and Disclaimers
PLEASE READ THIS SECTION CAREFULLY AS IT LIMITS OUR LIABILITY TO YOU.
3.1 Calculation Accuracy
All calculations, including debt totals, payment amounts, interest calculations, and remaining balances, are based solely on the input values provided by you, the user. WE ARE NOT LIABLE FOR ANY ERRORS, INACCURACIES, OR MISSED CALCULATIONS that may result from:
- Incorrect data entry by users
- Software bugs or computational errors
- Currency conversion inaccuracies
- Rounding differences
- Mathematical discrepancies of any kind
3.2 Deadline and Reminder Accuracy
WE ARE NOT LIABLE FOR MISSED DEADLINES, FAILED REMINDERS, OR DELAYED NOTIFICATIONS. While we strive to deliver reminders and notifications accurately and on time, we cannot guarantee:
- Timely delivery of email or SMS reminders
- Accuracy of due date calculations
- Proper functioning of notification systems
- Delivery to correct recipients
It is your responsibility to independently track and manage all debt collection activities and deadlines.
3.3 Logic Errors and Software Defects
WE ARE NOT LIABLE FOR ANY LOGIC ERRORS, SOFTWARE BUGS, SYSTEM FAILURES, OR TECHNICAL DEFECTS that may affect the Service, including but not limited to:
- Data loss or corruption
- Incorrect sorting or filtering of records
- Display errors or UI glitches
- Export or import failures
- Integration issues with third-party services
- Security vulnerabilities
3.4 No Financial or Legal Advice
OweMeList does not provide financial, legal, or tax advice. The Service is a record-keeping tool only. WE ARE NOT LIABLE FOR ANY FINANCIAL LOSSES, LEGAL DISPUTES, OR TAX CONSEQUENCES resulting from your use of the Service. You should consult with appropriate professionals for financial, legal, or tax matters.
3.5 Maximum Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
4. User Responsibilities
As a user of OweMeList, you agree to:
- Provide accurate and complete information when using the Service
- Verify all calculations and data independently before making financial decisions
- Maintain backup copies of important debt records outside of the Service
- Use the Service only for lawful personal debt tracking purposes
- Not use the Service for commercial debt collection or business purposes
- Comply with all applicable laws and regulations regarding debt collection in your jurisdiction
- Keep your account credentials secure and confidential
- Not share your account with others or allow unauthorized access
- Report any bugs, errors, or security issues to us promptly
5. Acceptable Use Policy
You agree NOT to:
- Use the Service for harassment, threats, or abusive communications
- Send excessive or spam reminders to debtors
- Violate any laws related to debt collection, including fair debt collection practices
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with or disrupt the Service or servers
- Use automated tools to scrape or extract data from the Service
- Reverse engineer, decompile, or disassemble any part of the Service
- Upload viruses, malware, or malicious code
- Impersonate others or provide false information
Violation of this Acceptable Use Policy may result in immediate termination of your account.
6. Account Creation and Data Ownership
6.1 Account Creation
You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
6.2 Data Ownership
You retain ownership of all data you input into the Service. However, you grant us a license to store, process, and display your data as necessary to provide the Service.
6.3 Data Backup
While we perform regular backups, we strongly recommend that you maintain your own backup copies of important debt records. We are not responsible for data loss.
7. Service Availability and Modifications
We strive to provide reliable service, but we do not guarantee uninterrupted or error-free operation. The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.
We reserve the right to:
- Modify, suspend, or discontinue the Service at any time
- Change features, functionality, or pricing
- Perform maintenance that may temporarily affect service
- Limit or restrict access to certain features or users
We will attempt to provide notice of significant changes, but are not obligated to do so.
8. Payment Terms and Subscriptions
8.1 Free and Paid Plans
We offer both free and paid subscription plans. Paid plans are billed on a recurring basis (monthly or annually) as selected during signup.
8.2 Payment
You agree to pay all fees associated with your subscription. All fees are non-refundable except as required by law.
8.3 Cancellation
You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing period. You will not receive a refund for the remaining portion of your subscription period.
9. Termination
We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including:
- Violation of these Terms of Service
- Fraudulent or illegal activity
- Non-payment of fees
- Extended periods of inactivity
- At our discretion for any other reason
Upon termination, your right to use the Service will immediately cease. You may export your data before termination. We may delete your data after account termination.
10. Indemnification
You agree to indemnify, defend, and hold harmless OweMeList, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another person or entity.
11. Warranty Disclaimer
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.
12. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions.
